Mumbai: Comedy shows have been a major USP for channels to draw more viewers. Shows with gripping storylines and a huge dollop of drama book the slots for weekdays, so to bring an airy entertainment most channels have comedy shows or comic strips. But not all shows would reach the ladder of success. It has been a case of hit or flop time and again.

Coming to the names of the show there is usually a team that handles the decision of giving a quirky name that could grab the eyeballs. Due to which we often see shows named after a famous song or an inspiring expression. These names could sometimes put you in trouble under the IPC of Trademark act 1999. 

Well, the Founder of The Comedy Factory Manan Desai indeed proved the power of the Indian judiciary could turn the tables for a national channel and make them change the name of their upcoming show completely. The Comedy Factory and Manan have been entertaining the audience for over a decade, they are not just regionally or nationally known but an internationally renowned company. 

Tellychakkar got in touch with Manan to know about the lawsuit, "This began in the last week of May when I came across the news about a show coming with the same name as my brand that took more than a decade to reach its place. I got in touch with their Production team and sent them an official letter regarding the issue. I also sent a legal notice to the channel and production in the month of June requesting them to change the name, but my concern was ignored."

"After continuous tries to reach out for the solution, I finally decided to take the matters to the Bombay High Court and filed a lawsuit against the channel stating that they cannot use the title ‘The Comedy Factory’ as I have got that name registered under trademark laws. While it is against the laws to use the same title or name, it even creates confusion in the minds of audiences," Desai added. 

"They first agreed on moulding the name by adding their house mark to the name and slightly changing it but Comedy Factory remains. This created a major digital injury as their campaigns on social media had our tags. We objected to the change and mentioned that they cannot use the name Comedy Factory at all!'', says Manan.

The lawsuit lasted for two hearings where the Plaintiff aka Manan had an upper hand over the defendants and right before the final verdict the defendants agreed to change the name completely. It is indeed a historic triumph for the comedian and an extremely vital lesson for the audience to understand the critical aspect of Trademark laws.
